1. Acceptance of terms

By creating an account or using Health and Kind (“the Service”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service. These Terms form a legal agreement between you and KCF LLC (Kindness Community Foundation), based in Newport Beach, California, United States.

2. About the Service

Health and Kind provides:

• AI-powered health guidance and triage (not medical advice)
• Guidance on finding independent helpers, therapists, and care professionals — we do not yet have a verified network, and say so on the relevant pages
• A community forum for peer support
• Child care guidance resources

Health and Kind is a technology platform. We are not a healthcare provider, and our AI does not provide medical diagnosis or replace professional medical judgment.

3. Eligibility

You must be at least 16 years old to create an account. By using the Service, you confirm that you meet this requirement. If you are adding a child profile, you must be the child's parent or legal guardian.

4. Account responsibilities

You are responsible for:

• Keeping your account credentials secure and confidential
• All activity that occurs under your account
• Providing accurate information in your profile
• Notifying us immediately of any unauthorised use at contact@kindnesscommunityfoundation.com

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users or helpers
• Post false, misleading, or harmful health information
• Impersonate any person or entity
• Attempt to access other users' accounts or data
• Use the Service to provide medical diagnosis to others
• Scrape, crawl, or otherwise extract data from the platform

We reserve the right to suspend or terminate accounts that violate these rules.

6. Helpers and professionals

Health and Kind does not currently have a verified network of helpers, therapists, doctors, or carers. Find Help and Child Care are guidance-only today, not a directory of vetted people. The plan, once real helpers exist: they will be independent third parties, not employees of Health and Kind, and any agreement you enter into with one will be directly between you and them. We will state plainly on the relevant pages once verification is live and what it actually checked.

7. Medical disclaimer

Health and Kind does not provide medical advice. The content and AI responses on this platform are for informational and guidance purposes only. They do not constitute professional medical advice, diagnosis, or treatment. Always seek the advice of your doctor or other qualified health provider with any questions you may have about a medical condition. In an emergency, call your local emergency number. 8. Intellectual property

All content, trademarks, and technology on the Health and Kind platform are owned by KCF LLC or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission. You retain ownership of content you post (such as community posts), but grant us a licence to display it on the platform.

9. Limitation of liability

To the maximum extent permitted by law, KCF LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, which is provided free of charge.

10. Termination

You may request deletion of your account at any time by emailing us — see your profile settings for the link. We may suspend or terminate your account if you breach these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

11. Governing law

These Terms are governed by the laws of the State of California, United States. Any disputes shall be subject to the exclusive jurisdiction of the courts of California.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or platform notice. Continued use of the Service after changes take effect constitutes acceptance.
